We negotiate and draft financial agreements
We negotiate and draft financial agreements for clients entering new relationships, or even for clients in intact relationships who want to have clarity about asset division and maintenance arrangements if separation occurs.
Financial agreements give both parties clarity about their current financial circumstances, expectations from the relationship, and expectations in separation.
They are particularly suited to clients in the following situations:
- Women who intend want to ensure that they will be adequately provided for in separation, particularly where they may be giving up a career to have children or to support their husband’s career, and their entitlement under the Family Law Act may not equate to economic parity with their husband. With cost-of-living pressures and housing costs in Sydney, this is a growing use case for financial agreements.
- Men and women who have already been through a relationship breakdown. Some of these clients have experienced the worst of divorce with extended litigation and legal costs. They want to ensure that any future separation is speedy and clear.
- Clients in intact relationships who similarly wish to have clarity as to what will happen in the event of a relationship breakdown.
- Men and women in mature-age relationships, who want to ensure that their assets go to their preferred beneficiary under their Will, which may be to their adult children, grandchildren, or a not-for-profit of choice.
- Parents and grandparents who are considering giving family gifts, and who want to ensure that the gift ‘stays in the family’, may make gifts contingent on their offspring entering into financial agreements.
